Guidelines for Rental of Ball Fields for Leagues:

Renter must be 21 with a valid ID. Before the Park Department considers rental of facility for league rate, Renter must also fit all guidelines set by the Park Department for definition of a Tournament/profitable cause. In the event that the renter will be using the premises for a profitable organization, the Parks and Recreation Department will be entitled to 15% of all the entry fees of the teams participating in the Tournament/Profitable organization. All profitable events must be set and agreed upon by both the organizer and the Parks and Recreation Department on a date which is suitable. All fees must be paid in full before any preparations will made to the ball fields. The event will be considered a profitable event if the following takes place: 1) The charging of teams and or admission to the facility whether it be selling tickets, gate admission, or entry fee. 2) The selling of concessions on the facility grounds. (Please note: The Parks and Recreation Department had first opportunity to sell concessions at any given event scheduled on park property. If the Parks and Recreation Department exercises the right to sell concession at the event, no other organization is allowed to sell any concessions of any kind during the duration of the rental period.) 3) The selling of keepsakes, T-Shirts, or other profitable items sponsoring the event.

Under no circumstances, for any reason, is the Parks and Recreation Department responsible for the refunding or the rescheduling of any event postponed. However rescheduling may be permitted only according to the availability of the field or facility and at a time which is convenient for the Parks and Recreation Department.

The renter will be responsible for having adequate help or staffing to assure that there will not be any unlawful conduct of the spectators or the entertainers. If there is discovered to be, it is required that the Parks and Recreation Department and the city Police Department be notified immediately. (This may include, but not limited to: vandalism, violent disputes, gambling, illegal drug use, etc…)

Leagues using the Babe Ruth field does not guarantee the use of the batting cages. The batting cages are on a first come first serve basis and not part of the field.

A fee of $50.00 will be charged for the preparation of the ball field. Also a fee of $50.00 will be charged to remove a mound. There will be no mound removal between May 1st and July 1st. A $100.00 deposit will also be required and will be returned pending that there was no damage and the trash and dugouts were left in good shape. In the event the application is not approved, the fee will be promptly returned. In all other circumstances there will be no refunds.

In order to secure the renting of the facility by a profitable organization, the reservation must be submitted at least 10 business days before the scheduled date of the event. This allows adequate time for the Parks and Recreation Department to discuss and approve the reservation. All profitable organization reservation must be considered and approved by the Park Superintendent before further actions occur.

Renter accepts the premises in its present condition at the beginning of the rental period and convenants that the premises will be in as good condition at the end of the rental period. If during Renter’s rental period, damage is done to the premises, the facility, or equipment, as a result of the act or neglect of any person using said premises, facility or equipment under Renter, Renter shall be responsible to City for the reasonable cost of repairing the same.

Renter shall not carry on or permit to be carried on any activity in or on the premises or the facility other than the activity authorized by this agreement.

This Rental Agreement is made subject to the rules and regulations concerning use of the described facilities as stated by the Parks and Recreation Department, which are made a part of the Agreement by reference.

As between the parties hereto, Renter agrees to be responsible for any injuries or damage to person or property occurring in or on the rented premises during the time rented to Renter, and Renter agrees to indemnify and hold harmless the City against any and all claims that may arise from said injuries or damages. Renter, by making this agreement does not do so for the benefit of any third person sustaining injury in or upon the rented premises. The purpose of this provision is solely, as between the parties hereto, to place the risk and burden of loss on the Renter. Special Events insurance is required. Upon the League Presidents’ signature, it ensures that all teams insurance for each team or the league as a whole. The Parks and Recreation Department cannot be held accountable for any injuries.

The Park and Recreation Department will be the only person allowed to prep a field for rental use. Under no circumstance is anyone other than the Park Department Employees allowed to posses any type of tool used for penetrating the ball field for personal gratification on ball field premises. The Park Department Employee must be on duty and have appropriate authorization for the Parks Superintendent in order to alter any areas of the ball field at the Renters request.

This Rental Agreement may be terminated by either party upon giving immediate notice to the other; provided, should Renter carry on or permit the carrying on of any activity in or on the rented premises other than that provided for in this Agreement, or should Renter or any person using the premises during Renter’s rental period violate any of the aforesaid rules and regulations, City may immediately terminate this agreement.

RAINOUTS: All rainouts will be determined by the Dexter Parks and Recreation Department. In the event that it is decided by the Park Department that a game is rained out, the renter has the option to reschedule the game for a later date that is convenient with the Park Department and the renter. There will be no refunds if the renter chooses not to reschedule.
